Terms and Conditions of Sale (T&Cs)
Museum of Illusions Geneva
Each museum is operated by an independent company, franchised under the Museum of Illusions network.
These Terms and Conditions of Sale apply exclusively to the services sold by the Museum of Illusions Geneva.

ARTICLE 1: PRELIMINARY PROVISIONS AND ACCEPTANCE
These Terms and Conditions of Sale (hereinafter the “T&Cs”) govern the sale of services (hereinafter the “Services”) offered within the Museum of Illusions Geneva (hereinafter “MOI” or “the Seller”) and sold to individual and/or group customers (hereinafter “Client(s)”).
The T&Cs apply to all sales of Services made at the Museum’s ticket counter or online via the Museum of Illusions Geneva website: www.moigeneve.ch (the “Website”).
The Seller offers Clients (i) entertainment and leisure services in the form of self-guided museum visits (“Standard Tickets”) and (ii) other ancillary services (gift shop, workshops, special events, etc.).
The term “Admission Ticket” refers to the ticket entitling the Client to a self-guided visit on a specific date or during a defined period.
Any purchase of a Service implies full and unconditional acceptance of these T&Cs by the Client.
MOI reserves the right to modify the T&Cs at any time. The applicable version is the one in force on the date of the order.
Amendments do not apply to already confirmed orders unless expressly agreed by the Client.
All changes are published on www.moigeneve.ch with their effective date clearly stated.

ARTICLE 2: THE SELLER (RESPONSIBLE ENTITY)
The Services covered herein are organized and sold by:

ARTICLE 3: SERVICES OFFERED
MOI notably offers:

  1. Admission tickets for self-guided or guided visits
  2. Ancillary services (gift shop, merchandising, workshops, special events)
  3. Group or educational packages
    An “Admission Ticket” grants access to the museum visit on the specified date or during the indicated period.

ARTICLE 4: ORDERING SERVICES
Services (hereinafter “Orders”) may be purchased:

  1. At the ticket counter, Rue de la Confédération 2, CH-1204 Geneva
  2. Online via www.moigeneve.ch
    Each Order must specify the selected Services and, where applicable, the age of participants.
    The Seller reserves the right to limit the number of tickets per Order.
    4.1. On-site Purchase
    The Client selects the desired Service and pays immediately.
    4.2. Online Purchase
    For online Orders, the Client must provide the required information (name, email address, etc.) and select the desired date and time.
    The Client may review and correct the Order details before confirming.
    The Order becomes final once the T&Cs are accepted and full payment is received.
    A confirmation email summarizing the purchase and including the digital Admission Ticket(s) is sent to the Client. This confirmation serves as proof of the transaction.
    4.3. Quantity Limits
    MOI may limit the number of tickets per Order, depending on the Museum’s maximum visitor capageneve or operational needs.

ARTICLE 5: PRICES
Prices are those displayed on official communication materials and on the Seller’s Website.
All prices are shown in Swiss Francs (CHF), including all taxes (VAT included).
The price of an Admission Ticket includes at least one self-guided visit for one person on the date or time slot indicated.
Children may enter free of charge up to the age specified by the Seller and must always be accompanied by an adult.
The Seller ensures full price transparency in accordance with Article 3 of the Swiss Federal Act Against Unfair Competition (UCA / LCD).
The Client will be informed in advance of any additional fees — such as online payment, booking, or processing charges — which, if applicable, will be clearly displayed before confirming the order and payment.

ARTICLE 6: PAYMENT TERMS AND METHODS
Payment for Services must be made in full at the time of the Order, in Swiss Francs (CHF).
6.1. On-site Payments
Accepted payment methods include cash, standard debit/credit cards (Visa, Mastercard), and local digital payment options accepted by the Seller (e.g., Twint).
6.2. Online Payments
Online payments can be made by credit card (as specified during the Order) or via Twint, using a secure payment solution that guarantees confidentiality and data protection.
The Client’s account is debited upon confirmation of the Order.

ARTICLE 7: ADMISSION TICKETS AND ENTRY CONTROL
7.1. Ticket Validity
Each Admission Ticket is valid only for the date and/or time slot indicated.
E-tickets are valid when presented on plain white paper or displayed on a smartphone screen.
7.2. Access Control
Tickets are checked at the Museum entrance. The Seller reserves the right to verify the Client’s identity and eligibility for any reduced fare.
Acceptable IDs include a valid passport, national ID card, residence permit, or student card.
Eligible categories for reduced rates include students, seniors, and persons with disabilities (with valid proof).
Any ticket that is illegible, damaged, or already scanned will be considered invalid and denied entry.
7.3. Late Arrivals
Clients arriving after their booked time slot may be denied entry without refund. Where possible, another time slot may be offered subject to availability, but without guarantee.
7.4. Ticket Resale
Reselling Museum Admission Tickets is strictly prohibited. The Seller reserves the right to cancel any ticket purchased outside official sales channels without refund.

ARTICLE 8: REDUCED RATES
Reduced fares (students, seniors, persons with disabilities, etc.) apply only upon presentation of a valid official document matching the reduction category.
Failure to present such proof will render the ticket invalid. The Client must then pay the price difference for a standard ticket or may be refused entry without refund.

ARTICLE 9: MINORS
9.1. Supervision
All minors under 16 years of age must be accompanied by a responsible adult throughout their visit.
9.2. Responsibility
The accompanying adult is solely responsible for supervising the minors in their care and for any damage they may cause to the Museum’s property or to third parties.

ARTICLE 10: EXCHANGES, CANCELLATIONS AND WITHDRAWAL RIGHTS
10.1. By the Client
Admission Tickets and ancillary services are non-exchangeable, non-refundable, and non-modifiable.
Under Swiss law, the right of withdrawal does not apply to leisure activities scheduled for a specific date or period.
10.2. By the Seller
If the Seller must cancel or substantially modify a Service (e.g., due to temporary closure), the Client may refuse the change and obtain a full refund.
Refunds, made by bank transfer, will be processed within thirty (30) days following the cancellation notice.
This refund constitutes full and final settlement under Swiss contract law (CO).

ARTICLE 11: GIFT VOUCHERS
The Seller may offer gift vouchers (hereinafter “Vouchers”) allowing the future purchase of Admission Tickets or services.
11.1. Validity
Unless otherwise stated on the Voucher or the Website, Vouchers are valid for ten (10) years from their issue date, in accordance with Article 127 CO on the limitation of claims. After this period, the Voucher expires.

11.2. Use
Vouchers can be redeemed at the Museum counter or online, subject to availability.
11.3. Type of Voucher

  • Nominal Vouchers: issued in the name of a specific beneficiary, personal and non-transferable unless expressly approved by the Seller.
  • Bearer Vouchers: not issued in a specific name. The person presenting the voucher is presumed the rightful holder. Lost, stolen, or fraudulently used vouchers cannot be replaced, and MOI accepts no liability.
    11.4. Non-Refundable
    Vouchers are non-exchangeable and non-refundable. They cannot be converted into cash or used for partial refunds. If the service price exceeds the voucher’s value, the Client must pay the difference.

ARTICLE 12: CLOAKROOM AND PERSONAL BELONGINGS
The Seller generally does not provide a supervised cloakroom. Lockers or storage areas, when available, are offered free of charge and under the Client’s sole responsibility.
The Seller is not liable for loss, theft, or damage to personal items left unattended. Visitors are advised not to leave valuables unsupervised.

ARTICLE 13: LIABILITY AND OPERATION
The Seller is responsible for the proper performance of Services.
However, no liability is accepted for indirect damages or disruptions beyond the Seller’s control (e.g., internet outages, external technical failures).
The Seller may, at its discretion, modify operating conditions or close parts of the Museum for maintenance, safety, or force majeure reasons without prior notice.

ARTICLE 14: FORCE MAJEURE
MOI shall not be held liable for any failure or delay resulting from force majeure as defined by Article 119 of the Swiss Code of Obligations (CO).
Events considered force majeure include natural disasters, fires, power outages, pandemics, strikes, and any unforeseeable, unavoidable, and external events.
In such cases, obligations are suspended without liability.
Where possible, MOI will offer an alternative date for the affected Service.
If performance becomes permanently impossible, the Client will be refunded the amounts paid, excluding any further compensation.

ARTICLE 15: WARRANTY AND DEFECTIVE PRODUCTS
In accordance with Articles 197–210 CO, the Museum of Illusions Geneva guarantees that all products sold in its shop are free from material defects upon delivery.
The Client must inspect the product upon receipt and report any defect in writing within five (5) working days.
The burden of proof lies with the Client.
In case of a confirmed defect, the Museum may replace the item, offer a price reduction, or issue a refund.
Risk passes to the Client upon physical delivery. For postal deliveries, risk transfers upon handover to the carrier (Art. 185 CO).
Return shipping costs are borne by the Client until the defect is confirmed. If a defect is verified, MOI will reimburse or cover the return costs.
The legal warranty expires two years from the purchase date and does not apply to discounted or clearance items.

ARTICLE 16: VISITOR CONDUCT AND MUSEUM RULES
Access to the Museum is subject to compliance with safety, hygiene, and internal regulations.
MOI reserves the right to inspect bags, deny access, or remove visitors without refund for misconduct, public disturbance, or damage to exhibits.
Smoking (including e-cigarettes), alcohol consumption, running, or bringing animals (except certified assistance dogs) are strictly prohibited.
Photography and filming are allowed for personal, non-commercial use only.

ARTICLE 17: PERSONAL DATA PROTECTION (FADP)
MOI collects and processes personal data (name, email, etc.) to manage orders, access control, and — with consent — marketing communications.
Data may be shared with third-party service providers (ticketing, payment, or hosting) under confidentiality and data protection agreements.
The Seller implements appropriate security measures under the Swiss Federal Act on Data Protection (FADP).
Clients have the right to access, rectify, delete, or request portability of their data (Art. 28 FADP) and may contact the Federal Data Protection and Information Commissioner (FDPIC) in case of dispute.

ARTICLE 18: IMAGE RIGHTS
Visitors are informed that photographs or video recordings may be taken within the Museum for communication, archival, or security purposes.
By participating in public events, the Client authorizes MOI to use their image incidentally in this context, without compensation.
Any objection must be sent in writing to [email protected] prior to or during the visit.

ARTICLE 19: INTELLECTUAL PROPERTY
All texts, images, logos, trademarks, and visual or audiovisual materials belonging to the Museum or featured on www.moigeneve.ch are protected by copyright and trademark law.
Any reproduction or use without prior written consent from the Seller is strictly prohibited.
Photos taken by visitors for personal purposes may not be used for commercial purposes without authorization.
ARTICLE 20: SEVERABILITY CLAUSE
If any provision of these T&Cs is deemed invalid or unenforceable by a competent court in Geneva, the remaining provisions shall remain fully valid and enforceable. The parties agree to replace the invalid clause with one of equivalent economic effect.

ARTICLE 21: LANGUAGE VERSION
In case of discrepancies between the French and English versions of these T&Cs, the French version shall prevail.

ARTICLE 22: GOVERNING LAW AND DISPUTE RESOLUTION
22.1. Applicable Law
All sales are governed by Swiss substantive law, excluding the United Nations Convention on Contracts for the International Sale of Goods (CISG).
22.2. Jurisdiction
Any dispute regarding the validity, interpretation, or execution of these T&Cs shall fall under the exclusive jurisdiction of the courts of the Canton of Geneva, Switzerland.
22.3. Mediation or Conciliation
In case of dispute, both parties agree to seek an amicable resolution before initiating legal proceedings.
The Client may contact a recognized Swiss consumer mediation body, such as the Centre de médiation des affaires (CEMA) or another competent cantonal mediation authority.
22.4. Complaints
Complaints must be submitted in writing to the Seller’s Customer Service ([email protected]) within a reasonable time and no later than fourteen (14) days after the Service has been provided.
